LivWise nv attaches importance to your privacy.


With this privacy policy LivWise nv informs the user about the processing of personal data and the associated rights. By using our website, the user gives implicit consent to possible processing operations.


LivWise nv, Vaartlaan 9, 9800 Deinze (hereinafter: “the controller”) respects the Belgian Law of 30 July 2018 on the protection of natural persons with regard to the processing of personal data and Regulation of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

PROCESSING OF DATA

Your personal data is processed to optimise your personal user experience.


When you create an account on our website, we ask you for the following information: company name, name, addresses (billing and delivery), e-mail address, payment details, and other information necessary to perform our services.


You can also choose to subscribe to our newsletter. Your email address will then be used to send you information about our services, products, events or other LivWise related information. We may use one or more service providers to manage these messages, but your information will not be shared with third parties without your consent.


The personal data you provide will be processed for the following purposes:

  • General services and customer management of the controller. We do this for a proper processing of your purchase and invoicing based on the performance of the agreement that you have requested.
  • To inform you about offers, promotions and other useful information for existing customers based on our legitimate interest, or your explicit prior consent in all other cases. This can be done through newsletters, personal mailings or other relevant communication channels.
  • For the improvement of the services and protection against errors, fraud based on our legitimate interest.
  • For statistical purposes and after your explicit prior consent: in order to permanently improve our website, we need the following information: IP address, place and time of your visit, the pages you have visited, the time you have spent on our website and surfing behavior. This website uses Google Analytics, a web analysis service provided by Google Inc. (“Google”). Google Analytics uses "cookies" (text files placed on your computer) to help the website analyse how users use the site. The information generated by the cookie about your use of the website (including your IP address) will be transferred to and stored by Google on servers in the United States. Google uses this information to keep track of how you use the website, to compile reports on website activity for website operators and to offer other services related to website activity and internet usage. Google may provide this information to third parties if Google is legally obliged to do so, or insofar as these third parties process the information on behalf of Google. Google will not combine your IP address with other data available to Google. You can refuse the use of cookies by selecting the appropriate settings in your browser. However, we point out that in that case you may not be able to use all the features of our website. We only place these cookies if you give your prior consent on your first visit to our website. More information about cookies can be found below. You can determine the data that you share with the controller yourself. These data will only be processed for internal use. The controller will never sell this data to third parties without your explicit consent. The data can only be passed on to third parties if this is necessary to achieve the purposes and to guarantee you an optimal service (For example: with an order your address will be passed on to the transport company).

We may transfer your personal data to affiliated companies or third party service providers located outside the European Economic Area ("EEA"). However, to ensure that your personal data is adequately protected, we require our third party service providers to include one of the transfer mechanisms specified in the GDPR and approved by the EU Commission. For example, we have concluded an agreement with Google and Magento based on the Standard Contractual Clauses of the European Commission.


The controller takes relevant measures to avoid misuse or unauthorized access. Data will not be kept longer than necessary to achieve the purposes.

RETENTION PERIOD

We keep your personal data for as long as this is necessary in function of the purposes of the processing. For legal reasons, we keep your billing data for at least 7 years after the last billing date.

SECURITY OF YOUR PERSONAL DATA

We have taken the appropriate technical and organisational security measures to guarantee the security of your personal data. Awareness training of our staff, encryption, antivirus software, SSL certificates, access management to the back-end, DPIA, privacy by design.


Under no circumstances can LivWise nv be held liable for any direct or indirect damage resulting from incorrect or unlawful use by a third party of the personal data.

THE USE OF 'COOKIES'

During a visit to the website, 'cookies' can be placed on the hard drive of your computer. A cookie is a text file that is placed by the server of a website in the browser of your computer or on your mobile device when you visit a website. Cookies cannot be used to identify persons, a cookie can only identify a machine.


We place the following categories of cookies:

RIGHT TO ACCESS / RECTIFY / REMOVE PERSONAL DATA

The controller will act on this within one month of receipt of the request.


You can also object to the processing of your personal data by the controller at any time. However, the latter can affect your services and user experience. Under applicable laws and regulations, you may have the right to access your personal data, restrict the processing, rectification and removal of your personal data that the controller holds about you. We take all commercially reasonable steps to verify your identity before disclosing or making changes to your personal information to protect your privacy.


You can only invoke this right if your application invokes one of the following cases:

  • The data is no longer required to achieve the purposes.
  • You withdraw your consent for processing. This is possible, for example, when there is no longer a legal basis for this processing.
  • You object to the processing and there are no compelling reasons for the processing.
  • You can demonstrate that the data has been processed unlawfully.
  • The personal data must be erased in order to comply with a legal obligation imposed on the controller by Union or Member State law.
